litigants bible. That book is titled "<span style="color: red;"><a href="http://www.nolo.com/products/represent-yourself-in-court-ryc.html">RepresentYourself in Court, How to Prepare & Try a Winning Case</a></span>, Paul
Bergman, J.D. and Sara J. Berman, J.D.."
For around $25 one can get this book, or purchase the eBook for around
$35 at the publishes website @www.nolo.com.
This book is your best bet for understanding the workings of the courts
on the cheap. It's written so that we laymen can grasp basic legal concepts,
and it's where I first learned that our courts are concerned with the basis in
facts and the law. </div>

Most public and
college libraries will shelve a few copies of "Represent Yourself in

same, "rather than being used as sources of authoritative statements of
law, legal encyclopedias will be more often used as tools for finding relevant

law dictionary. The "Holy
Grail" of law dictionaries for me is "Blacks Law
Dictionary" Available at most
public libraries, and a must for any book house claiming to be a law library.
If this book is not available, you're not in a law library, and if you don't
see one in a prospective attorney's office RUN! </div>

Starting with a set
of facts, the plaintiff or the defendant has to gather evidence to show that
said facts did or did not occur. Then
based upon the occurrence or non-occurrence
of some facts he or she must state what the law says if a set of facts
has or has not happened. Example: if one takes something that doe not belong to
him or her, or he has no legal right to take that thing a theft occurs. If he or she can prove that they did not take
or had a legal right to take the thing a theft has not occurred. </div>

because she has admitted that she paid half, and the trier of the facts will
want to see proof of payment, hear testimony from both sides as to a binding
contract to only partake of the bottle at the same time, and further see if Mr.
Boozer deceived the Misses in any way.</span></div>

were in NJ, where comment to 2C:20-2[5] Claim of right; theft from spouse says:

another." See 2C:20-1h and State v. Mejia, 141 N.J. 475, 495 (1995). If the defendant, in fact, owns the particular

When one embarks
down the road of doing legal research, either in prosecuting a civil action or
defending in a civil or criminal action, one must understand the basics of the
law. I previously discussed "God's Law
& Mans Law" within that posting. Now we must move on to "Mans
Laws" and or a more detailed look at the laws our government has passed
and we consent to follow. </div>

The first source of
law one should turn to is the law that sets up the system of government
itself. This law comes in the form of
the "Constitution." A
constitution declares basic rights of persons, it grants or declares religious
freedom, freedom of speech, trial by jury, and the peoples right to be left
alone. </div>

In the U.S. we have
the "<a href="http://www.archives.gov/exhibits/charters/constitution_transcript.html">Constitution of the United States of America</a>" and the individual
States have their own "State Constitutions" as well. Acting under the power of the Constitution
the Legislatures are empowered to pass laws called "Statutes," or the
collection of the statutes are called "legislation." Federal and State legislation may be passed
on any subject within the limits imposed by their respective constitutions. </div>

The Legislatures do
not have the time nor expertise to enact all the laws that are needed, so it
often creates agencies of government to make special rules. An example would be <a href="http://nj.gov/casinos/licens/info/index.html">New Jersey's CasinoControl Commission</a>. Rules made by
departments or agencies of the government are called "Administrative
Regulations" or codes. In New Jersey they have the <a href="http://nj.gov/casinos/actreg/act/">New Jersey CasinoControl Act</a>, which enables the <a href="http://nj.gov/casinos/actreg/reg/">New Jersey Administrative Codes on Casino Gaming</a>
in that state.</div>

The Legislature
further delegates power to local governments on the municipal level. At the municipal level these local

( Look up your city's Ordinances at <a href="http://ecode360.com/">eCode360.com</a>) So within this post we see how law starts
with the "Constitution", which allows for "Statutes" to be
enacted and government agencies to be formed, which intern enact
"Administrative Regulations."
We have also looked at laws on the city or municipal level which are
called "Municipal Ordinances", and they are enacted under the power
granted by government agencies. </div>

It is important to
remember this hierarchy of laws because the same applies to courts, and

should we just jump into a civil or criminal action. Research has to be done, and we have to learn
to do proper research. </div>

Primary Law is found
within written constitutions and the enactment of legislatures (and in some
jurisdictions through the vote of their electorates); rulings and regulations
issued by authorized administrative bodies; and the body of law found in the written
opinions of the courts. An easy way to remember it is by looking at the United
States first as a whole, and the nation is formed by the Constitution, which
allow there to be a government. </div>

After looking on the
national level, in the case of the U.S.
We think Federal law which goes from coast to coast. But then there are the individual States

left alone. So we get State law, the state constitutions allow counties to be
formed in which there are cities. Hence
statutes of a state, regulations of a county such as zoning laws, then city
ordinances. </div>

If you are dealing
with constitutions, legislation, or decisions of the highest court of a
jurisdiction you are dealing with what's known as "Mandatory primary"
laws. One arriving at JFK airport in New
York from lets say Cuba, and being arrested for violating our nations drug laws
would receive a charge for violating a Federal Statute, and the decisions of
the Supreme Court of the United States holds the most weight and must be
followed. </div>

Beyond the primary
sources of the law above attorney's and courts use many other types of law

says on page 1 in the second paragraph that: "Most people think of the
criminal law as something like the Ten Commandments, a long list of
thou-shalt-nots, only much longer duller, and more obscure. But the Ten Commandments would not do as a
criminal code, and not only because there are just ten of them. As criminal
code, the Ten Commandments have serious shortcomings."</div>

above we can see that the so called shortcomings of the Ten Commandments have
not been solved, and in this writers opinion, a greater conundrum has been
created because the person of average intelligence has to hire a lawyer to demystify the volumes of laws they submit, and or consent too.</span><span style="font-size: 11pt;"> </span><span style="font-size: 11pt;">What do you think, are there too many laws?</span></div>

goes further by stating that "the law is the whole body of such customs,

One standing before a judge in a court of law might find that
source to be a little weak given his or her circumstance. Why? In a court
of law one must understand the concept of "authority." For this
post lets define "authority" as what the court follows or agrees upon
as carrying weight.</div>

If one wants to proceed to court with definitions of words, terms
or phrases holding weight in court, he or she will need a copy of the heavy
legal dictionary that is recognized by most courts as the authority on
definitions of words, terms and phrases. That would be <a href="http://www.blackslawdictionary.com/Home/Default.aspx">Blacks LawDictionary</a>. This source can be purchased on the web by clicking the link
and it is available at most public libraries and at your local law library as
well.</div>

recognized and cited dictionary, but there's others such as Ballentines Law
Dictionary which you will find cited along with Black's in some case law. These
legal dictionaries give several definitions for the law. I have found that the
simplest to set to memory is: "The law is a combination of Constitutions,
Statutes, Regulations and Decisional Case Law."</div>
